Learning Objective: In a course on rental activities and passive activity limitations, a student learns how to classify rental vs. nonrental activity (including the 15 day rule, the 7 and 30 day short term rules and the Augusta Rule), how to apply material participation tests and the real estate professional exception, and when the special $25,000 active participation allowance (and its phaseout) can offset nonpassive income. The curriculum covers practical grouping/aggregation elections, the self rental rule, related party and room/short term/foreign rental issues, and conversion rules when a home becomes rental property. Students also study deductible vs. capitalized costs, depreciation (bonus and Sec. 179), recapture and Sec. 1250 consequences, passive credits and NII exposure, carryforwards of passive losses and other tax attributes, information reporting obligations, and planning/documentation steps a preparer should use to compute, substantiate, and optimize rental activity tax results.
